Democrats in the House of Representatives were unsuccessful today in an attempt to pass an extension of federal unemployment insurance (UI) benefits. The bill, HR 6419, would have extended UI benefits for three months for workers who have exhausted the typical 26 weeks of benefits provided by states. The House voted, 258-154, on the measure, short of the two-thirds majority that was required because the bill was brought to the floor under suspension of the rules. Unemployment benefits are set to expire on November 30th under current law. An estimated 2 million American will lose benefits if Congress does not act by the end of the month.

Pennsylvania Penalty Bill for Misclassifying Construction Workers Sent to Governor

The Pennsylvania House gave final legislative approval Oct. 5 to a bill (H.B. 400) that provides for fines and jail time for construction industry employers who knowingly misclassify employees as independent contractors. The bill will be considered next by the governor, who has 10 days to act on it; it would take effect 120 days after enactment. The House voted 109-90 to concur in Senate amendments to the Workplace Misclassification Act, which is aimed at deterring contractors from trying to avoid payment of workers' compensation premiums and unemployment insurance contributions by misclassifying workers. The Senate approved the measure Sept. 29 on a 34-13 vote. The bill, which is backed by organized labor, identifies six criteria that a worker in the residential or commercial construction industry has to meet to be classified as an independent contractor.

Republicans are feeling good about the midterms — so good that they’ve started saying what they really think. This week the party’s Senate leadership stopped pretending that it cares about deficits, stating explicitly that while we can’t afford to aid the unemployed or prevent mass layoffs of schoolteachers, cost is literally no object when it comes to tax cuts for the affluent.

And that’s one reason — there are others — why you should fear the consequences if the G.O.P. actually does as well in November as it hopes.

on June 25, 2010, President Obama signed the Preservation of Access to Care for Medicare Beneficiaries and Pension Relief Act of 2010 (The Act) into law. The Act will temporarily reduce the required contributions to multiemployer pension plans by allowing sponsors to recognize the losses suffered in 2008 and 2009 over longer periods of time. The net effect of this change will enable plans to defer a portion of the contribution increases and/or benefit reductions that would have otherwise been required immediately to meet the plans’ funding improvement or rehabilitation plan targets. The Act contains several provisions that will provide funding relief to multiemployer pension plans. Plans are required to pass a solvency test in order to access any of these relief provisions, and plans that elect any of the provisions are subject to a restriction on benefit increases. A recent “study” commissioned by the U.S. Department of Veterans Affairs, and conducted by Rider Leavett Bucknall was found to contain numerous deficiencies by a Professor and Senior Economist at Colorado State University, who examined its methodologies. According to Dr. Kevin Duncan, PhD., “the conclusions of the study should be interpreted with caution.”

Among many deficiencies, Dr. Duncan cited the fact that the entire study is “opinion-based” and devoid of any statistical-based empirical evidence, and that the study is has a small sample size of only 22 respondents.

The International Union of Painters and Allied Trades (IUPAT) District Council 46 has represented workers for decades, and for the past few years have continued to participate as active members of the community through various outreach programs. More recently, IUPAT has urged its members to be more involved in the community with the “Member to Remember” campaign. District Council 46, located in Ontario, has also been an active participant in the Firgrove Community Learning Centre’s Back to School Program. As part of the Back to School Back-Pack Program, District Council 46 and their contributing contractors and suppliers gave away 1,000 backpacks with school supplies to kids from JK to Grade 12.
